Has any one had to deal with court appointed minors counsel?

If so please share advice

I have this done in feb '08, this person is not doing the "JOB" that she is to be doing to protect my 2 older boys from the harm that their mom & new husband are doing. ( the list is too long ) but it is all bad. Trust me I have been through just about every door that I could go through.. ....... HELP!!!!!!!!

can this be done at any time

can this be done at any time or do I have to wait till the next round of BS from the oh so great sacramento county Family court. I know about filing a motion or osc and things like that, just not about court appointed counsel.

I think you are talking about a GAL (gaurdian ad litem), which is the term used here in Colorado for an attorney appointed to represent a child. Remember that the GAL's job, AND the job of the Court, is that they are to look out for the child's best interest. Your attorney should have no hesitation filing a motion to address the harms you fear. Often an affidavit is attached to attest to the same, or a police report if applicable, or any other document that supports the motion. Your attorney can also move the court to appoint a new GAL if you think that is in the best interest of the child. While the justice system may not always treat fathers fair, they are usually very sensitive to the needs of children who are under their jurisdiction. A well drafted motion, wherein the arguments are written with respect to the situation, and not with personal snipes and attacks at your ex-spouse or the GAL, will be the best way to go.

As stated above by Gaming with Baby, your best move may be to hire a new attorney if your not getting the results you think your children need. It will be a little more expensive as the new attorney will have to invest some time reading the documents and getting up to speed on your case. But think of that as an investment in your children. I am not a family law attorney, but I have litigated many cases involving GAL's and social services, and I have always found that judges are sensitive to issues affecting the health and welfare of children.
