Son Falsely Accused of Rape

The older kids get the bigger the challenges we, as parents, have to help them overcome. 

Four months ago Grant, now an official adult at age 21, was accused of rape/non consensual sex by a disgruntled ex-girlfriend.  The girl filed a police report without any clear evidence - just her "she said" testimony. 

A police officer called Grant to notify him of the complaint but he was not arrested.  Tina and I immediately hired an attorney.  He advised Grant not to make any contact with the girl.  She, however, contacted him a couple of times but Grant did not reply.  

The police officer never called again and did not interview Grant to get his side of the story.  The officer would not return our attorney's phone calls and was uncooperative during the investigation.  Since he was not arrested the police officer had no obligation to give us a copy of the girl’s complaint or share facts that supported her complaint like the date, time and place she claimed the rape occurred, whether or not she had a vaginal exam…...etc  It was like going into a minefield blindfolded. One thing we did know was that neither she or Grant had scratches or bruises on their body.

Despite the lack of information and cooperation from the police, Grant, Tina and I treated the case as though it was going to trial.  I hired a PI and he collected valuable evidence that disputed the girl’s claim. 

Four months and $7,000 for attorney and PI fees later the girl posted the following message on Grant’s Facebook site.  “Why are you still investigating this case?  The charge has been dropped.”  

The police didn’t even call us!  We had to hear it from her???  And why is he contacting Grant???

What also sucks is that the girl will not receive any consequence for her false report and accusation.  And we as parents have no legal grounds to sue her for the attorney and PI fees.  Grant is the only one who can file a claim against her.  But after talking with the attorney he opted not to.   What this girl did was wrong but unfortunately from a legal point of view there is not much Grant can do.

My family learned a lot about how unjust the legal system can be and also how incompetent some police officers can be.  

It was also very scary that another person can fabricate a story to the police about your child and run the risk of jail time and ruining his/her life. 

We’re glad the case is over and it was worth the $7,000 to keep Grant out of jail.  Time to move on and wait for another of life’s crazy challenges to come our way.

My God Man!

 

I am so sorry to hear about this. You can sue the ex-girlfriend for damages and defamation of character if you are so inclined. You can if you wish go to the State Police or IA and complain about the non-arresting officer. (That won’t get you far as the dropping of a case is not there obligation to inform you if no arrest was made)

I must say, no matter how cold the comfort, you and your wife's response is amazing and absolutely praise worthy!

That Sucks!!!

Hopefully everything is over and it does not come back to haunt you guys down the road. At least hold on to all the info you got so in case it does then you can come out ahead of the game. WIll say a prayer for you guys.

Thanks for concerns and comments.  

Shit happens.  It's not what happens to you but how you respond to it.

Defamation of character is hard to prove in court.  And Grant has decided to leave this behind him and move on. 

This is one of those situations that was best to let go and chalk up as a learning experience.  

On the bright side it turned out to be an eye opening life experience for Grant and an opportunity to test his character, composure and critical thinking skills.  

Although Tina and I hired the attorney Grant handled all communication with him.  It was Grant’s case to handle not ours.  All I did was follow-up to make sure the attorney was doing his job.  I never asked about the details of the case and respected the attorney client relationship. 

Tina and I are very proud of the way Grant handled the situation.  He accepted and took on the responsibility of handling this matter and did a stand up job.   

We are also happy this matter was resolved before Grant left for Switzerland on July 15th.  He was invited to play in 4 professional International Beach FIVB Tournaments.  All of his expenses, except airfare, are paid and he has guaranteed prize money and chance to earn more with each match he and his partner win.  He’ll be in Switzerland for 6 weeks.

Glad it got resolved

So glad it got resolved. I think it was a great idea to hire the attorney just in case the case went somewhere. The ex-girlfriend may have been the unmature one by not considering the consequences of her actions.

Hey, I caught a little of FIVB on ESPN2 the other day. Has Grant been on TV yet?

No TV Time For Grant Yet.

Thanks for asking about Grant.  

Grant has to pay his dues and has a ways to go before getting tv time.  However, he was invited to play four FIVB Beach Tournaments in Switzerland.  All expenses paid except air fare.  There is also guaranteed prize money and he can earn more with each win he and his partner chalk up.  He'll be in Switzerland from July 17th to August 26th.  This means he will miss the rest of the AVP Tour but that's okay.  He is better off playing in Switzerland.  

Grant missed making this week's AVP main draw in NY by 1 game.  You can check the results of the Qualifier Tournament.  Teams in the Qualifier compete for four spots to the main draw.  It is single elimination.   Go to www.avp.com, click on the NY tournament, clic on live results or results, click on Qualifier.  

Other good volleyball news about his little brother, Matt, is posted in the "Kids and Sports" thread I submitted in the discussion forum.

I bet he does want to simply forget about it and if he paid the bill you should do just that!
